Ratio Decidendi

The court held that, although the statutory six-month period since the issuance of the grant of letters of administration had not lapsed, the absence of any dispute and the fact that the estate comprised only cash assets justified the early confirmation of the grant. The court further determined that the distribution of the estate should follow the decision already made by the Kadhis Court under Islamic Law of inheritance. Accordingly, the grant was confirmed and a certificate of confirmed grant was ordered to issue, with distribution as per the Kadhis Court's determination.
