Legal Issues
- 1 Whether the grant of letters of administration can be confirmed before the lapse of six months from issuance.
- 2 Whether the absence of disputes and the nature of the estate as cash only justify early confirmation of grant.
- 3 Whether the distribution as determined by the Kadhis Court under Islamic Law should be adopted.
Ratio Decidendi
The court held that, although the statutory six-month period since the issuance of the grant of letters of administration had not lapsed, the absence of any dispute and the fact that the estate comprised only cash assets justified the early confirmation of the grant. The court further determined that the distribution of the estate should follow the decision already made by the Kadhis Court under Islamic Law of inheritance. Accordingly, the grant was confirmed and a certificate of confirmed grant was ordered to issue, with distribution as per the Kadhis Court's determination.
Court Disposition
grant confirmed; certificate of confirmed grant to issue; distribution as per Kadhis Court determination
Orders
- The grant of letters of administration is confirmed.
- A certificate of confirmed grant shall issue.

Certificate of confirmed grant to issue. Distribution of the assets will be as already determined by the Kadhis Court under Islamic Law of inheritance.
