Ratio Decidendi

The court found that the administrator had provided a comprehensive and satisfactory account of the distribution of the estate in accordance with the will of the deceased. All concerns previously raised by the court and in the subject applications were addressed. Consequently, the applications dated 18th February 2014, 23rd May 2014, and 30th April 2015 were dismissed. The court further directed that any disputes regarding injunctive relief over land be pursued in the Environment and Land Court, and that any party aggrieved by the orders may appeal within twenty-eight days. The matter was ordered to be returned to the Kiambu court for final disposal.
