Ratio Decidendi

The court found that the applicants are the registered proprietors of LR. Ngandori/Kirigi/17 and that the respondents have not demonstrated any legal interest in the land following the revocation of the grant previously issued to the 1st respondent. There is no pending land dispute or appeal challenging the court's earlier decision. The restrictions placed by the respondents and Charles Mwaniki were not justified, as the respondents' interests were not recognized by the court and there is no legal basis for the continued existence of the restrictions. The court, therefore, held that the application to remove the restrictions was merited and allowed it as prayed.
