Ruling
1. This matter arises from Kisumu Chief Magistrate’s Court Succession Cause No. E342 of 2024. It is before this court for transfer to Maseno SPM’s Court which has geographical jurisdiction to hear and determine succession causes arising from its jurisdiction.
2. The deceased James Ayieko Otwala, from the letter dated 20th May 2024 by the Assistant Chief North Kapuonja Sub-location, hailed from North Kapuonja and all beneficiaries are known to the Assistant Chief. So are the assets listed.
3. In the premises, I order that Kisumu CM Succession Cause No. E342 of 2024 shall be transferred to Maseno Senior Principal Magistrate’s Court via e-file forthwith and upon receipt of the e-file, Maseno SPM’s Court to notify the Petitioner to move the court.
4. This file is closed.
