Succession Cause / Ruling on Application for Rectification of Grant

  1. 1 Whether the grant should be rectified to reflect that the deceased owned only half of Dagoretti/Kangemi/T.464.
  2. 2 Whether the name of the deceased administratrix should be corrected.
  3. 3 Whether all shares named in the grant should vest in the applicant.

Ratio Decidendi

The application for rectification of the grant was declined because the applicant failed to provide adequate proof that the named beneficiaries were deceased, did not specify the number or consent of the children of the deceased siblings, and did not demonstrate that those who signed had authority to do so on behalf of others. Additionally, the applicant did not sufficiently justify the need to hold the shares in trust rather than distributing them directly to the rightful beneficiaries. The court found these omissions fatal to the application and declined to grant the orders sought.
