Ratio Decidendi

The court held that it lacks jurisdiction to determine the protestor's claim as a purchaser for value within the probate proceedings. Such claims must be litigated in a civil court, and only upon obtaining a judgment or decree in the claimant's favor can the probate court give effect to such interests in the estate. As the protestor has not produced any civil judgment or decree establishing his entitlement to the disputed land, the court cannot confirm the grant or remove the caveat at this stage. The probate process must be held in abeyance until the dispute over the suit property is resolved in the appropriate forum. The protest is therefore dismissed, and the caveat remains in force...
