Ruling
1. The deceased James Osir Rawaka, according to the scanty documents filed in the lower court, it is not clear where he hailed from and no letter of the Chief was filed. In addition, the documents in support of the Succession Cause as filed are incomplete and insufficient for this court to transfer the Cause for hearing to any other court. It further appears that no court filing fees was paid.
2. I herewith return the lower court file CM Succ E208 of 2024 to Kisumu Chief Magistrate’s Court for better particulars to be sought and filed by the petitioner before this court can deal.
3. This file is closed. Lower court file to be returned with this order and ruling.
