Judgment
1. The instant two succession causes have not been consolidated but they are twined for reasons that the estates belong to husband and wife, beneficiaries of whom are the same.
2. 3. Representation of the estate was vested on representatives from the four houses being; Anthony Kimani Kihuga, Donald Kamuru Kihuga, Vincent Njogu Kihuga and Peter Mucheru Kihuga. The deceased in Succession Cause No. 85 of 2007 died on 25th of August, 1994. She had no children and therefore survived with the same persons as those listed in Succession No. 34 of 2007. Representation to her estate was sought by the same individuals and pursuant to this court’s ruling dated 16th December, 2022, they were confirmed as representatives of the estate of the late Tabitha Waithera Kamau.
4. Vide this court’s order dated 12th July, 2023 in Succession Cause No. E085 of 2007, the parties were directed to file their respective modes of distribution anchored on the facts and the law in support of the entitlement of the benefit from the estate of the deceased.

9. In support of the outlined model of distribution, the beneficiaries filed submissions dated 16th April, 2024, which essentially captured the aspirations in the mode of distribution.
1st & 4th Petitioners’ submissions 10. The 1st & 4th Petitioner equally filed their submissions dated 24th November, 2023 in agitating the fact that the parties have been unable to agree on the mode of distribution.
11. Counsel identified four issues for determination as follows:a.Whether there are assets available to the estate of James Samuel Kihuga Chege (deceased) capable of being devolved to the beneficiaries?b.Who are the beneficiaries to the estate of James Samuel Kihuga Chege (deceased)?c.What mode of distribution should be applicable to the estate of James Samuel Kihuga Chege (deceased)?d.Whether Jan C Essilink (deceased) validly purchased a portion of L.R No. Kaptigat 772/7 from the deceased?
12. On the first issue, Counsel identified the various properties similar to those identified by the other beneficiaries as properties forming part of the estate. Further to that, counsel identified the beneficiaries of the estate and highlighted that there has been no quarrel as to the beneficiaries who should draw from the estate.
13. The next issue couched by counsel, was on the mode of distribution applicable to the estate of James Samuel Kihuga Chege. Learned Counsel Mr. Mosongo started by submitting that it is just, equitable and fair for the estate of the deceased to be divided among the houses according to the number of children in each house. in support of that position, this court was invited to consider the following:a.The family tree filed on the directions of this court, show all the dependents of the deceased.b.The schedule of assets attached to the family tree which show all the properties comprising the estate of the deceased.c.The affidavit for justification and proposed mode of distribution filed on behalf of the 1st Petitioner, 4th petitioner, and 30 other beneficiaries, which computes what share of the estate, each dependent will retain should the estate of the deceased be divided among the houses according to the number of children in each house.d.The Petition for grant of letters of administration intestate and chiefs’ letter show that at the time of his death, the deceased was polygamous, left only one surviving spouse Mary Njeri Kihuga (Now deceased), and all the children in each home are adults.e.The testimony of John Kihuga shows that all the children on the deceased grew up together under the care of the deceased and it is him who substantially erected the structures in the properties.f.The valuation report filed by the County Valuer shows how the estate is comprised of prime parcels of land of high value, without graves, and that the proprietorship records show that the properties were still in the name of the deceased at the point of his death, thereby negating any assertions that during his lifetime, the deceased had positioned on his properties or intended to settle or gift any of the dependents on the properties forming part of his estate.
14. It was submitted for the 1st Petitioner and 4th Petitioner that the guidelines in such circumstances as in this case ought to be Section 40 of the Law of Succession Act. Counsel invited this court to consider the decision in Mary Rono versus Jane Rono & William Rono (2005) eKLR. In the said decision, the Court of Appeal in considering the primary question on what the most ideal scheme to be adopted in the distribution the deceased’s estate between his two houses explained that equity and fairness in the distribution of an intestate estate between or among the houses where the deceased was married more than once is the principle underlying section 40.
15. This court was also invited to consider its decision in Re Estate of Joseph Eric Owino (deceased) (2022) eKLR, in which this court stated reasoned that there was no need for it to exercise discretion to establish a mode of distribution that is contrary to the equal distribution mandated by Section 40 of the Law of Succession Act. Counsel noted that this court in arriving at its decision in the said case, the following authorities were considered:i.Rono versus Rono Civil Appeal No. 66 of 2022ii.In the Matter of the Estate of Nelson Kimotho Mbiti (deceased) HCSC No. 169 of 2000iii.In the Matter Estate of Ainea Masinde Walubengo (deceased) (2017) eKLR.iv.In the Matter of the Estate of Veronica Njoki Wakagoto (deceased) (2013) eKLRv.In the Matter of Re Estate of Erman Bundotich Arap Cheptoo (deceased) (2022) eKLR.
16. From the above cited authorities, arguments for the 1st & 4th Petitioner were summarized as follows:a.That since the deceased was polygamous, and left one widow who has subsequently died, in the circumstances, the provisions of Section 40(1) of the Law of Succession Act ought to Apply.b.James Samuel Kihuga (deceased) left behind a total of 32 units that are entitled to inherit from his estate. The 1st house is made up of 9 units, the 2nd house is made up of 8 units, the 3rd house is made up of 8 units, and the 4th house is made up of 7 units.c.The deceased had both sons and daughters who ought to get an inheritance regardless of the ages and financial status.d.That there is no dependent in the state of James Samuel Kihuga (deceased) who is a young child that is still to be maintained, educated, and generally seen through life.e.The prime parcels of land of high value comprising the estate are without graves because the deceased members of the families were buried in cemeteries.f.That the proprietorship records show that all the properties in the schedule of assets comprising the estate of the deceased are still in his name, for he had not during his lifetime positioned, or intended to settle or gift any of his dependents on his properties.g.That parties to this cause have been unable to identify or agree on whether the deceased established his wishes and what his wishes were as to the mode of distribution of the properties comprising his estate.h.That for the past 16 years, parties to this cause have failed to agree on the mode of distribution of the parties comprising the estate of the deceased.i.That the proposed formulas in the mode of distribution filed by the other parties in this cause are self-seeking, not equitable, fair, or in the best interest of most of the dependents of the deceased which has caused continuous quarrels for the past 16 years.j.That the foregoing shows that there is no special circumstance for this honourable court to tamper with the mandatory provisions of Section 40 of the Law of Succession Act in exercise of its discretion.k.That parliament intended that in exercising your discretion, the number of children in each house be considered.l.That to end the quarrel between the parties herein, it is equitable and fair to divide his personal and household effects and the residue of the net intestate estate among the house according to the number of children in each house.m.That it follows that the most ideal scheme to be adopted in the distribution of the estate of James Samuel Kihuga (deceased) among the houses should be according to the number of children in each house.n.That the grandchildren be allowed to step into the shoes of their deceased parents, being children of James Samuel Kihuga Chege (deceased), and to directly take the share that ought to have gone to their deceased parents.
17. In concluding on this issue counsel urged this court to find and determine on the third issue that the mode of distribution to be applicable to the estate of JAMES SAMUEL KIHUGA CHEGE (deceased) is that his personal and household effects and the residue of the net intestate estate be divided among the houses according to the number of children in each house, and the grandchildren be allowed to step into the shoes of their deceased parents as contained in the proposed mode of distribution file don behalf of the 1st petitioner, 4th Petitioner, and 30 other beneficiaries.
18. As to whether Jan C Essilink (deceased) purchased a portion of L.R No. Kaptigat 772/7 from the deceased, it was submitted for the 1st and 4th Petitioners that the said Jan C Essilink has no valid claim for reasons that the sale agreement tabled by the 3rd Interested party revealed that it was not entered into by the deceased as the registered proprietor. In support of this argument, counsel cited the provisions of Section 45 of the Law of Succession Act and various authorities. He relied on the case of Benson Mutuma Muriungi v CEO Kenya Police Sacco & another (2016) eKLR; the decision in Re Estate of Boniface Njeru Ngemi (deceased)(2020) eKLR; Re Estate of John Mutio Mutua eKLR 2022 and Re Estate of Solomon Mwangi Waweru (deceased)(2018) eKLR.
19. In applying the said provisions and authorities on the issue of a bonafide creditor, counsel concluded as follows:a.A debt to the estate crystallizes upon the death of the deceased.b.The 3rd interested party has not provided documentary evidence to prove that he was indeed a creditor of the estate.c.The 3rd interested party does not fit into the description of a bona fide creditor under Section 66 of the Law of Succession Act, Cap 160 Laws of Kenya.d.The 3rd Interested party claim was not acquired by the deceased during his lifetime hence the 3rd interested party cannot be directly owed by the Estate.e.The 3rd Interested party lacks locus standi before this court and had no basis being a part of these proceedings.
20. From the foregoing and in concluding, counsel urged this court to deliver the parties from a longstanding quarrel for over 16 years on the appropriate mode of distribution.
21. Moving to Succession Cause No. E085 of 2007, various modes of distribution were fronted, noting the fact that the beneficiaries remain the same as they are step children to the deceased, Tabitha Waithera Kamau. Learned counsel Mr. Mosongo put it that the 2nd Petitioner and 31 other beneficiaries identified the following as a full inventory of all the assets of the deceased at the date of her death:No. Property Size

ELD/MUN/B16/80 Approximately 1. 840 HA Either sides filed their models of distribution together with their submissions, which I have studiously gone through and considered. Regarding this estate, the outstanding issue is that of Eldoret Municipality Block12/184 in which an affidavit of protest was made by the estate of Ngaruiya Kamau (deceased). According to Jane wanjiru Ngaruiya, an administrator to the estate of Ngaruiya Kamau, the late co-owned parcel No. Eldoret Municipality Block 12/184 together with the late Tabitha Waithera Kamau.That it was agreed expressly that the late Tabitha Waithera Kamau was to transfer half share to the late Ngaruiya Kamau but unfortunately died before the same could be transferred to her late husband. She therefore averred that the estate of the late Ngaruya Kamau is entitled to half share of the parcel of land known as Eldoret Municipality Block 12/184.
Analysis and Determination 22. Having captured considered the proposed mode of distribution as presented by the beneficiaries as well as their written submissions is support, the issue that distils itself for determination is which of the two modes of distribution is in conformity with the succession code in the two estates.
23. The approach of any distribution of an intestate estate under the Succession Act is to tackle the gender inequality inheritance by focusing on both men and women with particular focus on widows and widowers alike. It should be noted that the express provisions of the Act in Section 35, 36, 37, 38 and 40 does import the doctrine of equality as infused with equity in inheritance rights which mostly affects women and girls due to the deeply entrenched African culture and customs which give special recognition to partriachal characteristics of social economic, cultural and religious practices. The Constitution of Kenya 2010 embodies very clear national values and principles of governance which binds judges and magistrates to incorporate any one of them as the circumstances of the case demand to ensure the beneficiaries mainly the disadvantaged widows and girls are guaranteed their right to an equitable share in the inheritance of property of their late husbands of father for that matter. It is not surprising in my practice in law to experience a major shift of relationship between the male child and the girl child when it comes to transmission of inheritance rights of the immovable and movable assets of the deceased. However, with the new constitution this distortion of culture and customs discriminating against women and girls as against sons of the deceased has to find declarations in our constitutional democracy that they do constitute repugnant clauses to negative the Bill of Rights under Chapter 4 and Art. 40 of the Constitution on the rights to property. Regretably in succession matters, the limitation of our access to property rights by women and girls remains to be the major stumbling block in certain communities occasioning prejudice and injustice to the entire inheritance regime. The Kenyan Legal system prouds itself as having one of the best legal instruments both at the international law arena by dint of Art 2(5) and (6) of the Constitution and clear unambiguous provisions of the supreme law of the Republic which integrates multifacets elements of equity, equality, human rights, non-discrimination, inclusivity and protection of the marginalized. The signifance of these values cannot be denied with regard to protecting iheritance rights especially for women and it is the duty of the hierarchy of courts to engender the provisions of non-discrimination, right to equality, dignity and right to life as measures not to deprive any of the beneficiaries to the estate especially women either as widows or daughters entitled to an estate survived of the deceased. Based on the above legal provisions, it is expected that at the end of it all any proposed model of distribution adopted by this court would mirror in the final order with regard to property rights of this intestate estate.
24. In cases of this nature where the deceased died intestate and was a polygamous man survived by five widows and children the, anchor on distribution of his estate is Section 40 of the Law of Succession Act which primarily provides as follows;“(1)Where an intestate has married more than once under any system of law permitting polygamy, his personal and household effects and the residue of the net intestate estate, shall, in the first instance, be divided among the houses according to the number of children in each house, but also adding any wife surviving him as an additional unit to the number of children.(2)The distribution of the personal and household effects and the residue of the net interest within each house shall then be in accordance with the rules set out in sections 35 to 38”
25. In the Matter of the Estate of Nelson Kimotho Mbiti(deceased) HCSC NO.169 of 2000, Koome J directed that the estate of a polygamist be divided in accordance with the provisions of Section 40 of the Act. The estate was divided into units according to the number of children in each house with the widows being added as additional units. The same reasoning was also applied by Judge Ali Roni in the Estate of Ainea Masinde Walubengo(deceased) (2017) eKLR stating that “I am of the view that Section 40 of the Law of Succession Act will apply to the circumstances of this Case. Meaning that the Court will distribute the estate of the deceased according to each house taking into account the number of children in each unit including the surviving widow.”
26. On the same breadth, Art. 27 of the Constitution provides for equality and non-discrimination. The provisions of Section 38 of the Law of Succession Act provide for equal distribution among the children of the deceased. It then implies that the courts must at all time set out to provide for the dependants of the deceased in equal measure. Justice Musyoka In Re Estate ofJohn Musambayi Katumanga – Deceased[2014] eKLR held as follows:“The spirit of Part V, especially Sections 35, 38 and 40, is equal distribution, of the intestate estate amongst the children of the deceased. There have been debates on whether the distribution should be equal or equitable. My reading of these provisions is that they envisage equal distribution for the word used in Sections 35(5) and 38 is ‘equally’ as opposed to ‘equitably’. This is the plain language of the provisions. The provisions are in mandatory terms – the property “shall … be equally divided among the surviving children.” Equal distribution is envisaged regardless of the ages, gender and financial status of the children.”
27. I am also reminded of the Court of Appeal’s decision in Scholastic Ndululu Sura versus Agnes Nthenya Sura [2019] eKLR. This court is clothed with wide discretion to consider the unique set of circumstances on a case to case basis in distributing the estate equitably. The court of Appeal held as follows:“…although section 40 of the Law of Succession Act provides a general provision for the distribution of the estate of a polygamous deceased person, the court has the discretion to take into account factual circumstances of the particular case that may be relevant in ensuring equitable and fair distribution of the estate.’’
28. I have anxiously and carefully considered the two case dockets being Succession Cause No. 34 of 2007 and 85 of 2007 and the various issues canvassed by each of the legal counsels seized of this litigation with a view to unlock the impasse of what can be termed as a protracted inheritance dispute if the age of the cause of action is anything to go by from the record. In my considered view, the reading and appreciation of the features and characteristics incorporated in each model is expressly based on the statutory regulatory framework being the Law of Successio Act.
29. However, Learned Counsel’s Mosongo for the 1st, 4th Petitioner and 30 other beneficiaries contains a strong general commitment for all of the beneficiaries entitled to the heritage in succession cause No. 34 of 2007 and 85 of 2007. It provides that the beneficiaries or dependenants as commonly referred to are entitled to the equal protection of our Constitution 2010 and the provisions of Section 38, 40 as read with 41 and 42 of the Law of Succession Act. The main provision in the constitution for equality is Art. 27 which expressly provides inter alia that discrimination of persons in any form is prohibited and all persons are under any law guaranteed equal and effective protection against grounds of colour, birth, property, ethnic, sex, social origin, disability or other status or condition. It should be noted that each of the beneficiaries comes to the distribution altar with equal rights; None enjoys superior rights conditioned on birth, sex, culture, custom, gender to limit access to property rights acquired, developed and left as free estate for the benefit of his/her children.
30. Notably, if this court was to fully adopt the distribution model proposed by Learned Counsel Ms. Tum for the rest of the beneficiaries who are not in the category of the framework proposed by Learned Counsel Mr. Mosongo will result in unequal treatment between the beneficiaries of the intestate estate of the deceased. It is imperative to state that our constitution provides that no restriction or limitation may be placed on the exercise of any rights and freedoms unless the restriction or limitation is prescribed by a law, is reasonable, is recognized by International Human Rights standards, is necessary in a democratic society and does not negate the essential content of the right.
31. There can be now doubt that inspite of our Succession Act having been drafted prior to the Constitution 2010, the importance of the right to equality is emphasized in its scheme touching on inheritance and distribution of the intestate estate. In the dawn of the new Constitution, the guarantee of equality lies at the very heart of the supreme law of the Republic. It pearmeated and defines the very ethos upon which the Constitution was drafted and promulgated and in its preamble, acknowledged the pride of out ethnic, cultural and religious diversity and determined to live in peace and unity as one indivisible sovereign nation. That the same Constitution committed to nurturing and protecting the well being of the individual, the family, communities and the nation. That recognizing the aspirations of all Kenyans for a government based on the essential values of Human Rights, equality, freedom, democracy, social justice and the Rule of law. This new order created by our Constitution is one in which there is equality between men and women more specifically for families survived of the deceased and have a legitimate expectation on inheritance rights, should be able to enjoy the rights of inheriting both the immovable and movable assets of the deceased without being subjected to psychological, physical and emotional torture and cruel, inhuman or degrading treatment indirectly and directly under the guise of one Beneficiary or administrators placing roadblocks to limit those rights which by virtue of birth are underscored without any limitation. The rights of the heirs to the estate for their deceased father or mother are well founded under the Constitution and Succession Act. The role of the courts is to appropriately construe and protect those rights within the laid down provisions to entitle each Beneficiary a share of the estate without protracted litigation as it happens in our legal system.
32. When it comes to inheritance rights the principle of equality of individuals who are legitimate heirs under Section 29 of the Law of Succession Act does not require mere formal or mathematical equality but a substantial and genuine equality in fact.
33. From the foregoing, it is evident that the distribution of a polygamous family is not black and white. In order to achieve justice in a matter and not just this, it behoves this court to take into account every unique factors to arrive at a desired and equitable model of distribution. In light of these two models as interpreted, construed and proposed by the respective legal counsels with a measure of legal standing in representing each of the beneficiaries to this estate, summons for confirmation be and is hereby granted and the metrics of it take the scaled up model of distribution dated 24th July, 2023 for both estates.
34. It is not lost by this court the residual estate referenced as the Estate of the Late Tabitha Waithera Kamau being LR No. Eldoret Municipality Block 12/184 was in law and fact co-owned with Ngaruiya Kamau (deceased). As outlined in the guiding principles set out in the cases of Moses Bii v Kericho District Land Registrar & another [2015] eKLR and In Re Estate Dorica Lumire Mapesa [Deceased] [2018 eKLR justiciablity of the matter under the Succession Act calls for taking cognizance of that share being part of the free estate entitling the beneficiaries to inherit in this confirmation proceedings. The succession question on this residual estate is apparently placed within the purposive interpretation given by the Petitioners in their respective proposal for distribution which the court has adopted and cited as the basic structure to be applied in distributing the estate.
35. Within these categories, the Succession Code established complete equalty between the sexes, the only criteria deducable from the two models being the memnbership of a designated category as positively identified in Succession Cause No. 34 and 85 of 2007. It is within the intimate framework of the family that this court has tended generally to construe inheritance and marriage generally operating as an extension of the conception of family to include the spouse and legal relations as between the spouses who form the backbone of these two estate. Historically, the surviving spouse in the scheme of intestatacy is justifiable for the surviving spouse could succeed the one who has preceeded but in the case before this court, the category is actually unusual for none of the two spouses are alive. It is not difficult to state precisely the catergory of beneficiaries to each of the estate survived by the the two spouses for none of the categories of the beneficiaries in the two intestate estates expressly include the suriving spouse in this case particularly the father and wife have since been declared as deceased.
