Ratio Decidendi

The court found that the protestor's claim to the deceased's estate was based on an incomplete gift inter vivos, as the alleged transfer of land was not perfected by a registered transfer or a valid written instrument. Therefore, the gift was invalid in law. The deceased was survived solely by her daughter, the applicant, who is entitled to inherit the estate under section 38 of the Law of Succession Act. The protestor, being a nephew and not a child of the deceased, is not entitled to a share of the estate. The entire ½ share of LR Ntima/ntakira/565 and the monetary sum payable by the National Land Commission are to devolve wholly to the applicant.
