The court found that while the applicant had demonstrated the correct acreage of the suit property through official documentation, the error in acreage was so fundamental that rectifying it would result in a redistribution of the estate. Section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules only permit rectification of minor errors in names, descriptions, or time and place of death, not substantive changes to the distribution of the estate. Since the rectification sought would alter the shares of the beneficiaries, it fell outside the ambit of section 74.
