Ratio Decidendi

The court held that the rectified grant of letters of administration intestate, now including both Rodah Nanyama Kakai and Walter Japhed Angatia, is valid and effective for the purposes of distributing the estate. The only asset available for distribution is Ndivisi/Muchi/1620, as Kakamega/Matsakha/189 does not form part of the estate. The court applied section 40 of the Law of Succession Act, determining that the estate should be divided among the three houses of the deceased according to the number of units (children plus surviving widow) in each house. The first house is entitled to six units, the second and third houses to two units each, resulting in a distribution ratio of 3:1:1....
