Ratio Decidendi

The court found that while the deceased had the requisite testamentary capacity and the will was thumb printed by her, the document did not comply with Section 11 of the Law of Succession Act as it was not attested by two competent witnesses. The absence of the required attestation was admitted by the applicant. The court held that this omission was fatal to the validity of the will, rendering it invalid under Kenyan law.
