Ratio Decidendi

The court held that the Law of Succession Act mandates equal distribution of the estate among children of the deceased, regardless of gender. The applicant had already received a substantial portion of the deceased's property (parcel No. 644) during the deceased's lifetime, which must be considered in the final distribution. The only property remaining in the estate was parcel No. 645. Since one sibling, Deborah Wangithi, voluntarily accepted a smaller share (0.5 acres), the remainder should go to Mary Wanjiku Muyu. The applicant's claim to parcel No. 645 was rejected as he had already benefited from a prior settlement. The court confirmed the grant and ordered distribution accordingly.
