Succession Cause / Ruling on Application for Substitution of Administrator

  1. 1 Whether the court can substitute a deceased co-administrator with another person in the absence of a continuing trust.
  2. 2 Whether section 81 of the Law of Succession Act permits substitution of administrators in the circumstances of this case.

Ratio Decidendi

The court held that section 81 of the Law of Succession Act is clear that upon the death of one of several administrators, the powers and duties vest in the surviving administrator(s), except in cases involving a continuing trust. Since the present matter does not involve a continuing trust, there is no legal basis for substituting the deceased administrator with the applicant. The application for substitution is therefore dismissed. The court further directed the surviving administrator to move the court within 30 days to confirm the grant, failing which the grant would be revoked.
