Legal Issues
- 1 Whether the Kisumu CM Succession Cause No. E003 should be transferred to the Maseno SPM's Court based on the deceased's domicile and location of estate property.
- 2 What procedural steps are required for prosecution of the succession cause after transfer.
Ratio Decidendi
The court determined that the proper jurisdiction for the succession cause is the Maseno SPM's Court because the deceased was domiciled in Kombewa and the estate property, Kisumu/Kitmikaye/3014, falls within that court's territorial jurisdiction. The absence of the Chief's letter was noted, and the court directed that all necessary procedural documents, including consents and the Chief's letter introducing all beneficiaries, must be filed before any grant can issue. The original file is to be transmitted to Maseno SPM's Court, and the file before the High Court is closed.
