Procedural Posture

Succession Cause / Ruling on Application for Review and Joinder as Interested Party

  1. 1 Whether the applicant has established grounds for review and setting aside of the court's orders issued on 5th December 2018.
  2. 2 Whether the applicant should be enjoined as an interested party in the succession proceedings.

Ratio Decidendi

The applicant failed to demonstrate discovery of new and important matter or evidence that was not within her knowledge at the time the orders were made. She did not provide evidence of marriage to or dependency on the deceased 2nd petitioner to warrant provision from his share of the estate. There was no error apparent on the face of the record or any other sufficient reason to justify review. Furthermore, the applicant did not establish a sufficient legal interest or necessity for her enjoinment as an interested party in the succession proceedings. The court found that mere allegations without proof do not suffice, and the applicant's interest did not meet the threshold for joinder....
