Ratio Decidendi

The court held that, following the death of all original administrators, the law does not provide for substitution but requires the grant to be revoked and a new grant of letters of administration de bonis non to be issued to a suitable beneficiary with the consent of others. Although the application was brought under the wrong provision, the court invoked Article 159(1) of the Constitution to avoid undue technicalities and exercised its discretion under Section 66 of the Law of Succession Act to appoint Monica Rukwaro as the new administrator. The previous grant was revoked and a new grant de bonis non was ordered to issue to the applicant, enabling completion of the estate administration.
