Procedural Posture

Succession Cause / Correction of Erratum

  1. 1 Whether there was a typographical error in the acreage allocated to Phyllis Wanjiku Chege in the original ruling.
  2. 2 Whether the court has jurisdiction to correct accidental slips or omissions under Section 99 of the Civil Procedure Act.

Ratio Decidendi

The court found that there was a clear typographical error in the original ruling regarding the acreage to be distributed to Phyllis Wanjiku Chege. The total land available was 14 hectares (34.5 acres), and after allocating 1 acre for the burial site and 7 acres each to the siblings, the remaining acreage should have been 12.5 acres, not 22.5 acres as previously stated. Exercising its powers under Section 99 of the Civil Procedure Act, the court corrected the error to reflect the accurate distribution. The correction did not affect any other part of the ruling, which remained unchanged.

Court Disposition

Typographical error in the acreage allocated to Phyllis Wanjiku Chege corrected from 22.5 acres to 12.5 acres; all other aspects of the ruling remain unchanged.

Orders

  • Paragraph 54(c) of the ruling is corrected to read: 'The remaining Twelve point five (12.5) acres less road reserves shall be distributed in the name of Phyllis Wanjiku Chege.'
  • In all other respects, the ruling remains un-amended.
