Ratio Decidendi

The court found that all transactions for sale of the suit agricultural land between the applicants and the deceased or beneficiaries were void for lack of Land Control Board consent as required by section 6 of the Land Control Act. Sales by beneficiaries before obtaining a grant also contravened sections 45 and 82 of the Law of Succession Act, rendering them invalid. The applicants, having no valid contracts, could not be considered creditors of the estate but only of the individual beneficiaries who purported to sell their shares. As such, the applicants had no legal interest in the estate to support an application for revocation of grant under section 76 of the Law of Succession Act....
