Procedural Posture

Succession Cause / Ruling on Application to Reopen Succession and Revert Land Parcels

  1. 1 Whether the High Court is functus officio in relation to the estate of John Imbiakha Mbusa after distribution and transmission of assets.
  2. 2 Whether the subsequent subdivision and registration of land parcels post-confirmation of grant can be challenged in the succession cause.
  3. 3 Whether the applicant has locus standi to bring the application after the alleged demise.

Ratio Decidendi

The court held that its jurisdiction in the matter ended upon the confirmation of grant and transmission of the estate to the beneficiaries, specifically after the judgment dated 30.11.2011 and the subsequent registration of the land in the name of the beneficiary. Any issues arising from further subdivisions or transfers of the land parcels after the estate was distributed are outside the purview of the succession court and must be addressed before the Environment and Land Court. The court found itself functus officio and incapable of granting the orders sought by the applicant. Consequently, the application to reopen the succession cause and revert the land parcels was dismissed.
