The applicants did not demonstrate that the grant was obtained fraudulently or that they had a legitimate interest in the estate of John Kariuki Githu. However, the court recognized that there was a genuine dispute regarding the ownership of Parcel No. Loitokitok/Ngama/131, as both parties claimed it belonged to their respective deceased fathers.
