The court found that the Certificate of Confirmation of Grant dated 21st December, 2017 clearly specified the beneficiaries of KISUMU MUNICIPALITY/BLOCK 7/34, and the 3rd Respondent was not among them. The transmission of the property to the 3rd Respondent was therefore not supported by the grant. The 2nd and 3rd Respondents, as joint administrators, failed to provide any explanation for their refusal to execute the transmission/transfer documents as required. The court also noted that although an application for stay was certified urgent by the Court of Appeal, no stay order had been granted, and thus there was no legal impediment to granting the orders sought.
