The court found that the rectification of the certificate of confirmation to include parcels not mentioned in the Will was improper and fraudulent, as rectification cannot be used to introduce new properties into a testate succession. The properties in question, being subdivisions of LR No. Shawa/Gicheha/Kangakinga/Block 4/92, were not covered by the Will and should be dealt with under intestate succession. Regarding the bequest of LR No. Shawa/Gicheha/Kangakinga/Block 4/229, the court held that although the parcel was subdivided and part sold before the testator's death, the remaining parcel (292) substantially represented the original bequest.
