The High Court determined that it had not issued any grant of representation in this cause, and therefore there was no grant capable of being confirmed. The only valid grant was issued by the Vihiga Principal Magistrate’s Court in Vihiga SPMCSC No. 10 of 2013, and the High Court had not revoked that grant nor issued a new one. Consequently, any application for confirmation of grant in this cause was misconceived and without basis. The High Court had become functus officio after its orders of 16th December 2015, and all subsequent proceedings in this cause were null and void.
