The court found that the mediation agreement, which formed the basis of the confirmed grant, was not signed by all beneficiaries and resulted in an unequal distribution of the estate, with the son from the second house receiving a significantly larger share than the others. The court held that, in the absence of clear evidence of the deceased's wishes justifying such disparity, and in light of sections 38 and 40 of the Law of Succession Act, the estate should be distributed equally among the surviving children.
