Procedural Posture

Succession Cause / Summons for Rectification of Grant

  1. 1 Whether the court should rectify the grant to correct the acreage allocated to the joint beneficiaries M. Pardy Murunga Wabuge and Benard Nyongesa Wabuge from 1 acre to 1.5 acres.

Ratio Decidendi

The court found that the error in the acreage allocated to the joint beneficiaries M. Pardy Murunga Wabuge and Benard Nyongesa Wabuge was inadvertent and did not substantially alter the substance of the grant. The error fell within the scope of rectification contemplated by Section 74 of the Law of Succession Act and Rule 43 of the Probate and Administration Rules, which permit correction of minor errors in the grant. Since no beneficiary opposed the application and the rectification would not prejudice any party, the court held that it was appropriate to rectify the grant to reflect the correct acreage of 1.5 acres for the joint beneficiaries in the last schedule of land title No....

Court Disposition

Application for rectification of grant allowed.

Orders

  • An amended grant to issue with the foregoing changes.
