Ratio Decidendi

The court found that the applicant is entitled to appeal and that the court must prevent the appeal from being rendered nugatory. However, the court also recognized the respondents' right to enjoy the fruits of the judgment. Given the age of the matter and the need to balance the interests of all beneficiaries, the court exercised its discretion to grant a temporary stay of execution for 90 days to allow the applicant to seek further stay from the Court of Appeal. If no stay is obtained from the appellate court within that period, the certificate of confirmation shall be executed. The applicant was ordered to pay the costs of the application.
