Procedural Posture

Succession Cause / Ruling on Application for Removal of Restriction

  1. 1 Whether the restriction lodged against LR Karai/Gikambura/2515 should be removed.
  2. 2 Whether the court has jurisdiction to order removal of restriction on land not covered by the confirmed grant.

Ratio Decidendi

The court found that the restriction in question was lodged against LR Karai/Gikambura/2515, a parcel of land not recognized or distributed in the certificate of confirmation of grant, which only referenced LR Karai/Gikambura/571. There was no evidence of an amended or rectified grant including LR Karai/Gikambura/2515 as part of the estate. As such, the court held that it lacked the jurisdiction to issue orders regarding the removal of the restriction on a parcel of land not forming part of the confirmed estate. The application was therefore dismissed as the orders sought were not relevant to the subject matter of the confirmed grant.
