Ratio Decidendi

The court found that the two estates in question were not related and that there was no sufficient commonality of law or fact to justify consolidation. The orders for consolidation were made ex parte and without notice to the parties in Succession Cause No. 906 of 1995, which was improper. In the interest of justice, the court set aside the consolidation orders and directed that each succession cause proceed separately. The prohibition order on the property LR. No. DAG/KANGEMI/278 was to remain pending the determination of the summons for rectification. Each party was ordered to bear its own costs.
