Ratio Decidendi

The court found that the purported wishes of the deceased, as contained in the document dated 10th September, 1998, were ambiguous, lacked clarity regarding the subject property and acreage, and were not proven on the balance of probabilities. Even if such wishes existed, the court held that they could be disregarded if their implementation would result in injustice to some beneficiaries. The deceased died intestate after the commencement of the Law of Succession Act, and therefore, the applicable law for distribution is Section 40(1) of the Act, which mandates that the net estate of a polygamous intestate be divided among the houses according to the number of children in each house....
