The court determined that, in order to establish the validity of the Will dated 6th March, 2008, it is necessary to receive direct testimony from the advocate who witnessed the Will and from the two attesting witnesses. The executor's assertion that the witnesses exist and can be produced, coupled with the absence of their affidavits or oral testimony at the hearing, means the statutory requirements for proof of execution have not yet been fully satisfied. The court therefore directed that affidavits from the attesting witnesses be filed and that all relevant witnesses be produced for examination and cross-examination, in compliance with Section 11 of the Law of Succession Act and Rule 54...
