Procedural Posture

Civil Appeal / Judgment on Appeal Against Revocation of Grant

  1. 1 Whether the appeal was filed within the statutory time limit for appeals from subordinate courts to the High Court.
  2. 2 Whether the High Court has jurisdiction to hear an appeal filed out of time without leave of court.
  3. 3 Whether failure to seek extension of time to file the appeal can be cured by Article 159 or Article 48 of the Constitution.

Ratio Decidendi

The appeal was filed more than 30 days after the impugned ruling, contrary to section 79G of the Civil Procedure Act, and no leave was sought to file the appeal out of time. The Law of Succession Act and Probate and Administration Rules do not specify a time limit for such appeals, but Rule 63 imports the Civil Procedure Rules, making the 30-day limit applicable. The failure to seek extension of time is not a mere technicality and cannot be cured by constitutional provisions. The High Court therefore lacks jurisdiction to entertain the appeal, rendering it incompetent and liable to be struck out regardless of whether the respondent raised the issue.
