Procedural Posture

Succession Cause / Ruling on Application for Change of Advocate Post Judgment

  1. 1 Whether the application for change of advocate after judgment complies with Order 9 rule 9 of the Civil Procedure Rules.
  2. 2 Whether service of the application or consent between outgoing and incoming advocates was effected as required by law.

Ratio Decidendi

The court found that the applicant failed to comply with the mandatory requirements of Order 9 rule 9 of the Civil Procedure Rules, as there was no evidence that the application for change of advocate was served on the outgoing advocates, nor was there a consent filed between the outgoing and incoming advocates. The absence of either service or consent meant that the procedural conditions precedent to a change of advocate post-judgment were not satisfied. Consequently, the court held that it could not sanction the proposed change of advocates and dismissed the application with costs.

Court Disposition

application dismissed with costs

Orders
