Ratio Decidendi

The court found that the respondent was not a lawful wife or widow of the deceased, as previously determined in Milimani CMCC No. 47 of 2018, where it was held that although dowry was paid, no valid marriage existed between the respondent and the deceased. The court held that unless the judgment is overturned on appeal, the respondent's status remains as not being a widow. Consequently, the respondent lacked locus standi to apply for a grant of letters of administration ad litem. The court further found that the respondent obtained the grant by making a false representation that she was a widow, amounting to fraudulent misrepresentation under section 76 of the Law of Succession Act....
