The court found that the applicant failed to provide sufficient evidence of an advocate/client relationship with the respondent. There was no written instruction or acquiescence by the respondent for the applicant to act on her behalf in the succession cause. The only correspondence addressed to the respondent was a fee note, to which there was no response, and the majority of the correspondence was with a third party whose authority was not established. Consequently, the applicant did not discharge the burden of proof required to establish the relationship, and the bill of costs could not be sustained.

Motion to strike out the bill of costs allowed; bill of costs dismissed with costs to the respondent.
