Ratio Decidendi

The court found that the Applicant failed to provide evidence of personal service of the court order dated 18th July 2014 on the Respondents, as required by law for contempt proceedings. No affidavit of service was filed, and the court record did not show that the Respondents were personally served or were personally aware of the order. In the absence of proof of personal service or knowledge of the order, the Respondents could not be held culpable for contempt of court. The legal requirements for committal for contempt, including personal service and a penal notice, were not satisfied. Consequently, the application for committal was declined and the Applicant was ordered to bear the costs.
