The court determined that the estate of Joyce Kanjiru Njiru should devolve under intestate succession as there was no valid will. The children of the deceased are entitled to inherit as dependants under Section 29 of the Law of Succession Act. Grandchildren may inherit directly only if their parent (a child of the deceased) is deceased, in which case they step into their parent's share. The evidence established that Yvonne Mercy Debenham and Hanny Munene, as children of deceased children of the deceased, are entitled to their respective parents' shares.
