Ratio Decidendi

The High Court found that the evidence demonstrated LR Abogeta/L-Chure/839 was not an absolute gift to the deceased but was held by him in trust for himself and his mother, the 1st appellant. The continued occupation of the land by the 1st appellant and the deceased's father, as well as the manner of subdivision and transfer of the original family land, supported the existence of a trust. The trial magistrate's order disinheriting the 1st appellant was against the weight of evidence and was set aside. The estate was ordered to be distributed equally between the 1st appellant and the respondent (for herself and in trust for the deceased's daughter).
