The court held that the estate of the deceased, who was polygamous, must be distributed in accordance with Sections 40 and 42 of the Law of Succession Act. The statutory formula requires division among the houses based on the number of children and surviving wives, with previous benefits given to any house or beneficiary during the deceased's lifetime being brought into account. The court found no sufficient evidence that Githunguri/Kiairia/2132 was gifted inter vivos to George Ndirangu and thus awarded it wholly to the 1st protestor, who had developed and resided on the property.
