Ratio Decidendi

The court found that the respondent satisfied the requirements for grant of stay of execution and leave to appeal. The application was brought timeously. The respondent demonstrated that failure to grant stay would result in substantial loss, as the subject property (15 acres) could be disposed of, rendering the appeal nugatory. The court accepted that security for costs was not necessary at this stage since the decree was not for money and could be addressed during the appeal. Accordingly, the court exercised its discretion to grant leave to appeal and stay of execution pending the determination of the intended appeal, with costs to abide the outcome of the appeal.
