The court found that the consent order recorded on 16th October 1985 before V.V. Patel J was valid, binding, and had never been set aside. The subsequent Certificates of Confirmation of Grant, which purported to distribute the estate contrary to the clear terms of the consent, were therefore nullities. The failure of the parties to sign the consent did not invalidate it, as it was entered in the presence of the parties and their advocates and recorded by the judge.
