Ratio Decidendi

The court held that the applicable law for the distribution of the estate is the Law of Succession Act (Cap 160), as the deceased (Kanuthu Rugu alias Hannah Wanjiru Rugu) died in 1999, after the Act came into force. The argument that Kikuyu Customary Law should apply was rejected. The court found that the 1st and 2nd Administrators, as daughters of the deceased, are entitled to inherit their mother’s share of the estate, and that any attempt to disinherit them on the basis of gender or marital status is contrary to the Constitution of Kenya. The estate, being polygamous, should be distributed according to section 40 of the Act, with the properties devolving to the children of the joint...
