Procedural Posture

Succession Cause / Ruling on Preliminary Objection

  1. 1 Whether the Probate Court has jurisdiction to determine disputes relating to ownership of estate property claimed by a third party.
  2. 2 Whether the applicant, as an alleged purchaser, has locus standi in the succession cause.
  3. 3 Whether the summons dated November 27, 2020 should be struck out for want of jurisdiction and locus standi.

Ratio Decidendi

The court held that it lacked jurisdiction to determine the applicant's claim to ownership of the suit properties, as such disputes fall within the exclusive mandate of the Environment and Land Court under Article 162 of the Constitution and Section 13 of the Environment and Land Court Act. The applicant, being a purported purchaser and not a beneficiary, had no locus standi in the succession cause until her claim was established and crystallized by the ELC. Consequently, the preliminary objection raised pure points of law and was upheld, resulting in the striking out of the applicant's summons.
