Ratio Decidendi

The court held that the applicant had not demonstrated that he was the duly appointed personal representative of the late Nzioka Kimina's estate. Under Section 82(a) of the Law of Succession Act, only a personal representative with a grant of representation has the power to enforce causes of action on behalf of a deceased person. The applicant had not produced evidence of such a grant, and therefore lacked the legal standing to be substituted for the deceased in the pending application for revocation of grant. The application was thus incompetent and could not be allowed.
