Ratio Decidendi

Section 40 of the Law of Succession Act mandates that, in polygamous situations, the estate should be distributed proportionally to the number of children in each house, with surviving wives counted as additional units. The failure to involve all beneficiaries and the inclusion of a deceased administrator in the amended grant rendered the grant and its confirmation defective....
