The court found that while there were allegations of irregularity and possible fraud in the registration of LR No. Kiteta/Kakuswi/1091 in the name of Kivevo Kiilu, the probate court lacks jurisdiction to determine questions of ownership or validity of title. The court's role is limited to determining what constitutes the free property of the deceased for purposes of succession. Since the title is currently registered in the name of Kivevo Kiilu and any challenge to its validity must be brought before the Environment and Land Court, the property does not form part of the estates of the deceased Katuvya brothers for the purposes of this succession cause.
