The court found that the Petitioner, in seeking substitution as administrator and in applying for confirmation of grant, failed to disclose the existence of the Objector, who was a legitimate beneficiary as the second wife of the deceased's only son. This omission constituted concealment of material facts and misrepresentation, rendering the process of obtaining the grant and certificate of confirmation defective and contrary to Section 76 of the Law of Succession Act. The Petitioner’s own admission that the Objector was his stepmother confirmed her status as a beneficiary.
