The court found that the protestor, as the only surviving spouse of the deceased, ranks higher in priority than the petitioner, a daughter, for purposes of administration of the estate under section 66 of the Law of Succession Act. The grant issued to the petitioner was therefore defective for lack of consent from the protestor and is liable to revocation. The deceased died before the Law of Succession Act came into force, so distribution of the estate is governed by the applicable customary law, specifically Kipsigis customary law, as provided by section 2(2) of the Act.
