The High Court lacks jurisdiction to entertain an application for revocation of a grant that was issued by the Magistrate's Court. Section 76 of the Law of Succession Act vests the power to revoke or annul a grant in the court that issued it. The High Court's role is limited to hearing appeals from the Magistrate's Court in succession matters. Dismissing or striking out the application would be contrary to the spirit of Article 159 of the Constitution, which encourages substantive justice over technicalities.
