Ratio Decidendi

The court found that the applicant/objector was not a beneficiary of the estate of Kipsang Naniwet, as the entitlement to the disputed land parcel Kericho/Ainamoi/333 had already been determined in a prior judgment (Kericho HCCC No. 16 of 2010 (OS)), which awarded half of the property to the estate of Kipsang Naniwet and half to Sinei Sang. There was no evidence that the respondent obtained the grant fraudulently or by concealing material facts. The respondent was properly issued with letters of administration intestate, and the applicant's claim to a share of the estate was without merit. The application for revocation of the grant was therefore dismissed.
